The Affidavit is the ONLY way a divorce or family law litigant can present evidence at a motion and essentially tell their "story" to a judge. One mistake many self litigants make is arriving at a motion believing that they can tell their story to a judge orally. Unfortunately, the judge will listen to them patiently but nothing you say can be used.
Your evidence must be put to the courts by way of an Affidavit during the motion stage of family law cases, making this document a crucial form for self litigants to understand and use.
In our sample provided you will see an example of the necessary format and language for use in an affidavit. In this specific case the litigant is telling his/her story to show the lack of cooperation by the other litigant in truthfully revealing their financial records and he/she is requesting an order from the courts to have access to bank account records, business records and to be allowed to question the other litigant on these matters.
