If I have a signed pre-nup stating my husband owed me $50,000 borrowed against my home at the time of marriage, does that count against his debt at time of marriage if that home has been our marital home?
I’ve been separated for 3 months and was wondering if there is any way to claim my half of a car that my husband has owned for 5 years now. It was in both of our names, but he told me he has taken my name off the ownership since our separation. Can I force him to sell it so that I can get half of its value as it would be nice to be able to pay off some debt that I have, or can I prevent him from selling it without my consent? I have asked if he will sell the car and he refuses as he thinks it’s his car and I have no claim on it. We were married for 17 years prior to separation and have one child together. I am divorced and pay child support from previous relationship and have done so for past 7 years, daughter currently 16. I am in a new relationship and have lived with this person for 15 months. I have a question about spousal support. I know it isn’t tabled like child support but is spousal support usually granted? I made $58000 last year and my ex-wife made $190000 last year. I have been divorced since Dec 2002. I have custody of our two children, 8 & 12. I am taking the children to Orlando on August X for family vacation. Jeremy!! I want to thank you for answering my questions that I have asked you. I have one more thing I would like to explain to you and ask your advice. My main concern is my 2 boys, I don't care about the house or anything else that is a material thing. The lawyer that I have now is telling me that the judge's in this area don't agree with shared custody or one week with Mom and then the next week with Dad. If the courts and lawyer don't allow me to have shared custody of my boys for no real good reason could I ask you to review my case and make sure my rights as a father where not violated, and I wasn't denied shared custody for some other unknown reason that can't be explained. I believe my children deserve to live in a shared custody situation. They would both still go to the same schools and have the same friends and routines would not change other than having 2 places to call home.
If you pay a lawyer for a uncontested divorce and you hand deliver the divorce papers and the spouse does not sign the divorce papers...does the divorce automatically become a contested divorce?

My common law wife is pregnant with another man's child, we have decided to separate, we both own our home, the debt is larger than what the house is worth. We are both in the red in all our accounts. She wants to stay in the house with our 2 boys and put the house in her name. After 11 years of separation my husbands ex is taking him to court because he is refusing to pay $3000 towards a school trip their daughter wants to go on. All We have is a join credit card which the other party is the primary card holder and a car loan which the other party has full use of the car? I was also told to sign and return the documents by fed ex when I receive them. Isn't it automatically filed if I do not respond as I am not contesting anything?

Is it possible to get an equalization of finances if I have been separated for 7 years and have just been served with divorce papers. I was living off my inheritance and that is now depleted. Also I paid 10s of thousand of dollars during the separation in 2005 am I able to recoup that money in a civil suit. The money was paid out during the sale of a joint property and there was a lien that had to been removed prior to the close of the house.
I am representing myself in my divorce. I have filed the application and the respondent has a lawyer and they answered. I didn't know about the time frame in responding to his answer therefore I was required to file a case conference. It went before the judge June, 2009. The judge ordered the divorce. I went to the court house today to find out how to obtain the divorce now and the court clerk told me I was to wait until the respondent's lawyer filed his portion. They wouldn't explain to me what this means. They did give me a photocopy of the order. In my opinion that sounds like his lawyer can still hold it up until he files whatever paperwork is required to be filed. I have already agreed to pay the remaining portion of the fee as I filed it to begin with and paid the initial portion. My question: Do I actually have to wait until his lawyer files whatever the court clerk was referring to or can I proceed somehow without it?
I am going through a complicated divorce. My husband and I are separated and he has filed a motion to get me out of the matrimonial home. We were married for 5 years and have 2 children ages 5 and 3. He pays no spousal support, but I want to keep my medical benefits. Hello, I am in the process of getting a divorce. I have 3 kids and the soon to be ex stays home and looks after the kids. She is now looking for a job. We live in Whitby but she is looking for jobs further away, Belleville/Trenton area. My job is based out of Oshawa. If she gets a job and moves to Belleville with the kids I believe it will hurt my relationship with my kids (8 years old and under) because when the are settled in a new town I will be taking them away when the visit me. I won't be able to go to their activities and if they visit me in my town I will be pulling them away from their life in the new town. I feel they will grow to resent me for that. Can something be documented in a divorce agreement that she can't take the kids an unreasonable distance away from me? I am willing to move a commute to work somewhat but it sounds like she is not willing to even do that. Hope that makes sense. Hi, I have been separated since 2000, but legally separated since Oct 2004. I have tried twice to get a divorce and both time my x put a monkey wrench into it. Thus it only ended costing me money for nothing. Now after 2 yrs, I receive a letter from my x's lawyer stating that my x wants an uncontested divorce, and wishes that I proceed with one of the previous divorce applications that I started. Or do the necessary paper work so they can proceed. The letter was addressed in my maiden name. I did not respond to the letter, because I have wasted enough money trying to get a divorce and now if he wants one he can pay for it. Just yesterday, I received yet another letter from his lawyer, addressed again in my maiden name asking for a responds to his correspondence. Am I obligated to respond to this letter?
My wife and I have made up a separation agreement which we have both signed and was witnessed by my mother. Is this document legal? We both agree and we have no further issues to resolve. My wife has a Lawyer hired through legal aid who keeps telling her we have to go to court any way is this true. It seems like a waste of our time, the courts and money.
My separation agreement indicates that my ex husband has to pay child support until my children are finished their post secondary education and no age is specified. My son is in college and just turned 21. My ex husband says that there is a new law stating that he does not have to pay support anymore regardless of our agreement. I am a Canadian Citizen. I married in 1998 a man who is Pakistan in England. After so many years, I do not know where he lives now nor have I tried because I worry for my well being and safety. I know they have to serve him papers in person but if he does not live there now...can they just place ads in England papers for x number of weeks to find/notify him? What can you do if you file the initial divorce papers indicating you are separated for 9 years and the custom of the children has been assigned to the mother but you are unable to locate a copy of the original separation documents... and there is not a filed copy in the courts? Separation Agreement dated, 22 day of July, 1999, states that: ;Support for the child shall cease when the child: (i) withdraws from parental control; (ii) marries; (iii) becomes 18 years of age and the child is not longer attending a regular institution of learning; (iv) moves away from the home of the wife; (v) becomes self-supporting; or (vi) dies Upon any one or more of these events happening, the obligation of the Husband to pay maintenance to the Wife for the child shall cease forever.; Why did we have to re-install our child support payments when the mother finally took the child back after much begging on the child's part? Thank you. P.S., We spoke to original Divorce Lawyer and he basically advised that this was the way it was, we have to continue paying no matter what, if the child moves back in. This goes against the agreement as far I see it.
What can be done once divorce papers were filed, listing children that was already awarded custody and support payment in a separation agreement and no copy of the separation agreement can be found (separated 2000);the party filing for the divorce does not have a copy of the separation agreement and it's not in the courts (requested copy from the courts and it was reported no copy on file)and the other party will not supply the only copy that can be found. The Lawyer that was use by the part filing for the divorce has relocated - address unknown. Is there a way to get around this or get another copy of the separation agreement from family enforcement(one who enforce the support agreement). Please advise... looking to remarry and this is hindering the divorce process.
14 years ago my mother and father divorced. In the agreement, he agreed to continual spousal support (she had been a stay-at-home mother for the 22 years of their marriage) and it was ongoing at the time of death. It says in the separation agreement that he agrees to keep a policy of $250k in effect, separately, to care for this obligation if he dies. He has now passed, and we have found out that he did not keep the above insurance policy in effect. Further, he never made his equalization payment of $20k. Does my mother have the right to now get credit to his pension (he made new wife beneficiary - and my mother only released her interest knowing that he had to keep the life insurance in place)?...Also does she have right to any remaining assets in the estate to take care of these obligations?

My X-wife felt she needed $12,000.worth of cosmetic surgery after having a short ;relationship; with her boss. I was unaware at the time of the ;relationship;. She got implants, nipple reduction,tummy tuck etc. We nursed her back to good health and a year later she had an affair with another person and left the marriage, she said she planned to leave for several years but said nothing until she left. I have a question about custody. I have a separation agreement in place with my husband giving me sole custody of the kids. Another clause in my agreement states that I may live anywhere in or out of the country of Canada with the kids without his knowledge and/or consent. The access clause states that my husband has access to the children at a fair & reasonable time, convenient to myself (while we're residing in Canada). If I move out of the country (like to the USA), does that mean I can leave without telling my husband since I don't need his knowledge and consent. I'm not restricting his access (because the clause states while we reside in Canada). While we reside in Canada, I've never denied him any access and I won't. I'm concerned about this. Thanks.

Over the years in our home his family have helped us out for renovations and down payment saying it will be coming out of his inheritance. When I got married 2 years ago, my fiance convinced me to sell my house in Kitchener because he told me that we would have 2 others houses; the matrimonial home and his home in Ottawa which he owned himself and was a rental property. He did not at any time say to me that this house would be excluded from in the event of a divorce. Now of course after he told me he wanted a separation and divorce, he was quick to point out to me that I am only entitled to the increase of any value of that rental property during the 2 years we were married. My 20 year-old son is planning to move out of town (from Ottawa to Montreal) to attend his second year of university. Until now he has resided with his mother and I have been paying the Table rate support rate for him and his 18 year old brother. We estimate that his expenses next year will be approx. $7,000 for tuition, and $1,000/month for all other living expenses. He will be sharing the rent for an apt. for 12 months, and tentatively plans to reside there all year, including summers. He will only return for short visits, ie weekends, where he has the option to either stay with me or his mother, or just as likely, with friends. I have proposed that the $7000 tuition cost be paid out of our RESP fund, and the $1,000 living cost be split 3 ways, with our son paying 1/3 and the remaining 2/3 be split between my wife and I according to our relative incomes (which are approx. equal). He has savings and works PT and summers. My wife agrees in principal, but argues that I should continue to pay her the difference between what I pay her now for him as the second child, ie $500/month ($1390 (for 2 children) - $890 (remaining one child rate))and the approx. $350/month, which would be my share of his new living cost. This difference is only $150/month, but he is not planning to live with his mother, and I am still paying almost $900 for the remaining 18 year old. BTW, when our Separation Agreement was signed, the older child in question lived on his own (she had kicked him out for a year) and he is not mentioned in that Agreement (ie, for Custody or Child Support issues). There is no Court Order to pay child support for either of the children - but I have been doing so. Do I have a (strong) case to claim that any support for him should be restricted to paying him, directly, only my share of his planned living expenses, for 12 months a year, and that no additional payments to my ex-wife are warranted? Legally separated but no separation agreement. I was married for 16 months and we lived together for less than 5 years total. ( she claims more - I claim 45 months ). She had a house going into the marriage and so did I. She makes 110 - 120k per year and I make 140k. No kids. But we lived in my house - so I cannot claim it going in they say as it is the matrimonial home. Is there anyway that I can claim my house? Hi, I am a mature man, have been married and have grown children. I have been separated from my (ex)wife almost six years. Recently my girlfriend moved in with me. I want to understand how her moving in may impact me if we ever break up. I own a house (on my own, my ex has her own place as well), I pay the taxes, utilities and mortgage on my place. I recently moved to Scarborough and my ex (the mother of my daughter) lives in the High Park Area of Toronto. My normal visitation with her is standard: Every Wednesday and every other weekend. Since I live in Scarborough, but work at Bloor/Young, I generally get home by 6pm Wednesday from picking up her from the Baby sitters. Recently the Ex has decided to move to Mississauga. This will now make my Wednesday visits with her not feasible as our time will be spent mostly sitting in traffic and she would have to be up at 5am to get her to school on time Thursday morning. Question: Could I have stopped her from moving away that far and could I request for lowered child support to accommodate higher traveling costs?

I attended court on November 08 and received a court order that the other party shall forthwith pay me partial indemnity costs fixed at $2,500 inclusive of fee, disbursement and gst. To this date I have not received any of this money. My question is how to go about getting this order enforced so that I can receive the $2,500. The court we attended was in Barrie but I currently live in Toronto. The other party still lives in Barrie. I cannot afford a lawyer to try and get this money paid to me so I am looking for the least time consuming avenue (and least expensive avenue) in order to get the money ordered to me. Hi, My partner and his wife separated in May 2000. No separation agreement was done at that time. Once I came into the picture, 6 years ago, my partner initiated a separation agreement. It's been going on every since. Every time all the issues appear to be agreed upon and my partner's lawyer sends it to her lawyer for signature, the other side decides on something else that should be added. So back and forth it goes and very slowly I may add....months go by. My partner is an extremely gentle, fair man who works 60+ hours a week. In the agreement she got the cottage worth $300,000, $400,000 for 1/2 the matrimonial home and $5,000 per month and still she won't sign. Now she wants the alimony to continue after he retires at 65 (he is 61 now). She's a teacher's assistant who works 30 hrs/wk and get's all school holidays off yet the law says she should make the same as my partner who works twice as many hours? Not to forget my partner offered to pay for her to reinstate her RN license so she could go back to her original career and work more and make more money. She said no, why should she work so hard at 60. Furthermore, now she wants him to pay alimony after age 65. Does it ever end? She left him yet he's getting the shaft. I thought the law was fair. We are so frustrated. How long can she continue to have this go on and on? It's been almost 9 years. Does he not have the right to move forward with his life? Please help. Are there no statute of limitations on divorces? I should also mention he has 3 grown daughters ages 28-33, two of whom he still supports out of love as one is still in University and the other doesn't make enough to make ends meet. That takes roughly another $2-3,000 a month. Between that, the alimony and legal fees the poor man has nothing left. My husband filed a general application for divorce & costs in the Superior court of Justice. I have until April 10 to answer. I am not contesting the divorce. He has conceded to costs relating to said divorce. He has a lawyer I do not. I am currently preparing a separation agreement with said lawyer. This agreement will resolve my previous application for support in the family court. Date is scheduled for April 2 2009(in family court which I will withdraw with no liable costs) said agreement includes possessions, support & ; absolution of liability for costs on my behalf. They do not want to withdraw their application in the superior court. I have asked they at least change said application to simple. Can't this divorce be done in a lawyers office at HIS expense? He did agree to all costs assoc. with the divorce. Why do I have to make an appearance in the Superior court, incur costs, ect???? Hello! My friend got married in 1983, then in 1996 she divorced from her husband. This divorce was for convenience because they wanted to settle down in Russia, and it's easier to get a job and everything when you're single in Russia (funny but truth). Eventually her husband moved to Canada sponsored their children, then married her again (second time) in 2008 and sponsored her. She came to Canada a month ago and got her landed immigrant status. I live in Canada, and my husband lives in London, Uk, but we got married in Pakistan. Our marriage is not registered in Canada or UK since we just got married this past July. I want a divorce from my husband, but I don't think he will sign the papers. What are the options, time frame and legal fees that I'm looking at? We have no children and none on the way. I have been divorced for two years not but we never got the custody arrangement in order. Each year because his pay does change in such a large amount ($20,000) per year we review his tax assessment in order to get the correct support amount. My questions are 1. does he have to provide the full tax assessment? (last year he only provided page two and deleted all the other numbers) I think he lied about his income. 2. how long do I have to go after him for back dated child support, that would included day care costs because he is not paying the correct amount?
I need to know if my spouse and I have been separated for 1 year and there is no financial assets to be divided and there is no children and there are no support issues do we still need to complete a financial statement? We both agree that we want to go our separate ways and we just need to file for a divorce to make it legal. I have read all the information regarding joint uncontested divorce information but there is noting I can find that states that if there is no property, no investments no children and no support issues once so ever you do not have to fill in a financial statement. Please let me know as soon as possible because I have all the forms completed except the form 13 and form 13.1 Financial Statement (Property and Support Claim forms. Also we do not have a separation agreement we have both separated the property and we both have moved on with our lives we just need to make our divorce finial and we want to file a joint application so we can get our divorce completed.
